How to request silencio positivo from UGE
The official procedure is electronic. Generating the letter does not file it for you.

- 1
Check the deadline
Count 20 working days from the electronic submission date and check notifications for any formal suspension or request for documents.
- 2
Generate and review one letter per applicant
Use each applicant’s own REGAGE. A titular and each family member normally have separate filings.
- 3
File it through the Ministry’s electronic office
The official instructions say to enter the Law 14/2013 procedure, choose Alta de Solicitud, identify yourself, and use Subsanación to request the resolution by silence.
- 4
Keep the new receipt and monitor notifications
Download the filing receipt, check the expediente, and keep access to electronic notifications.
Where do I upload the generated PDF?
Open the Law 14/2013 procedure in the electronic office, identify yourself, and choose Subsanación. Attach the signed PDF to the applicant’s existing filing and submit it.

DIRECCIÓN GENERAL DE MIGRACIONES — MINISTERIO DE INCLUSIÓN, SEGURIDAD SOCIAL Y MIGRACIONESQuestions about positive administrative silence
No. When the law gives a period in days without saying they are calendar days, Saturdays, Sundays, and public holidays are excluded. Counting starts from the electronic filing in the competent registry, and a formally notified suspension may change the end date.
No. The PDF is a request asking the competent authority to issue a resolution or certificate recognizing the positive silence. Article 24 of Law 39/2015 governs the legal effect and proof of silence.
Yes, when the filing is an authorization under the relevant section of Law 14/2013 and the deadline conditions are met. Use the applicant’s own registration ID and generate a separate letter for each pending person.
Because the clock is usually paused. On entrepreneur files UGE has to ask ENISA for a report on the business plan — article 70.1 of Law 14/2013 makes that report mandatory, and article 22.1.d of Law 39/2015 lets the authority suspend the maximum period while it waits for it. So on startup applications the real wait routinely runs past 20 working days, and silencio positivo can only be argued once the ENISA report has come back and the suspension has ended. The suspension has to be notified to you; if it never was, that is a point in your favour.
How the UGE’s 20 working days and the ENISA wait work is on the UGE page.
Keep the filing receipt and monitor the expediente and electronic notifications. Note that under article 24.4 of Law 39/2015 the certificate is owed to you on the administration’s own initiative within 15 days of the deadline expiring, even without a request. If your dates, a suspension, or the scope of Law 14/2013 are unclear, obtain case-specific legal advice before relying on silence.

Not a clean case?
A notified suspension, a requerimiento you are unsure about, an ENISA report on an entrepreneur file, a change of representative, or dates that do not line up — those are the cases where a template is not enough. We handle Law 14/2013 files end to end from Barcelona.
This free generator provides a document template, not legal advice. A wrong filing date, a suspension, an existing decision, or a procedure outside the applicable part of Law 14/2013 can change the result.
